Privacy Policy

Pro Care Health Plan, while providing for your health benefits, is required by law to protect your personal and health information.  We are also required to provide you of this Notice regarding how we use and protect your information. Please review it carefully.

What Information We Have?

Personal Information – We have your personal information such as name, sex, date of birth, address, and other personal information.

Health Information – We also have health information provided to us by your health care provider for the medical care received by you.

Together, both personal and health information constitute Protected Health Information (PHI).

What is our Privacy Policy?

Pro Care has a privacy policy to protect your PHI.  Pro Care uses the PHI only for the purposes of treatment, payment, business operations or when required and authorized by law. Pro Care does not sell your information and only those people who have a need and a legal right may see your information.  Pro Care must get a written authorization from you for using your PHI for purposes other than stated above.

What are your Privacy Rights?

Here are your Privacy Rights within the law:

  1. Right to inspect and copy: You have a right to inspect your information that we have on you.  We may deny your request under certain circumstances.  You have the right to appeal our denial.  You may be asked to pay a nominal charge for copying your records.
  2. Right to amend:  If you feel that the information provided to you is incorrect or incomplete, you may submit to us changes in writing.  If these are denied, you will be provided a written reason for such a denial.
  3. Right to know about your releases:  You have a right to have a list of releases of the information made by Pro Care.  This list will not include information released for the purposes of making a payment, providing treatment and Pro Care’s business operations.  Also not included in the list will be the information already provided to you or your family members.
  4. Right to restrict disclosure of information: You have a right to submit a written request to restrict use or disclosure of certain information about you.  Pro Care may not agree to such a request.
  5. Right to request Confidential Communications: You have a right to request that your information be shared with you in a certain way or place.  Your request must be in writing and provided prior to our sharing information.
  6. Rights Under this Notice:  Please provide us with written request at Pro Care’s address to exercise your rights under this Notice.  Pro Care will be able to help you to prepare such a request, if you should need such help.

  

What if you need to file a complaint?

Complaints and Communications to Pro Care Health Plan: If you want to exercise your rights under this notice, communicate with us about privacy issues, or if you wish to file a complaint about us, you can call or write to us at the following address or number:

Pro Care will not penalize you for filing a complaint.

Complaints to the Federal Government: If you believe that your privacy rights have been violated, you have the right to file a complaint with the federal government. You may write to: Office of Civil Rights, Department of Health and Human Services, 200 Independence Avenue, S.W., Washington DC, 20201, Phone: (866) 627-7748, TTY: (866) 788-4989, or Email: ocrprivacy@hhs.gov. Pro Care will not penalize you for filing a complaint with the federal government.

Change of Notice:

Pro Care reserves the right to change this notice. A revised notice will be effective for health information we already have about you as well as any health information we may receive in the future. Pro Care is required by law to comply with whatever notice is currently in effect. If the changes are important, the new notice will be mailed to you before it takes effect.

Copies of this Notice:

You have the right to receive an additional copy of this notice at any time.  Even if you have agreed to receive this notice electronically, you are still entitled to a paper copy of this notice.  Please call or write to us to request a copy.
